Child marriage as ‘security’?

The legal age at which a girl can get married in Eritrea is 18 years, however many marry earlier as an act of great desperation.

Child marriage is prohibited in numerous international human rights instruments, namely; the Universal Declaration of Human Rights, the Convention on the Elimination of Discrimination against Women (CEDAW) the African Charter on the Rights and Welfare of the Child (ACRWC) and in the Protocol to the African Charter on Human and People’s Rights on the Rights of Women in Africa. That said, child marriage is nevertheless rampant on the African continent. According to the United Nations Children’s Fund (UNICEF) figures (2013), out of the 20 countries most affected by child marriage, Africa hosts 15. ‘Typical’ drivers of child marriage include customary/traditional beliefs, desire for economic gain or to provide security. I hesitated at the mention of ‘security’ because how does a minor gain security from being forced to engage in sexual reproduction, childbearing and birth within a completely unprepared body and mind?

Human rights and democratisation in Africa

The globalisation of human rights and democratisation has gained significant momentum in the 21st Century. It has proved to be the linchpin of progressive and sustainable socio-economic and political development for other continental organisations such as European Union and Inter-American Organisation. It is unfortunate that the African Union (AU) has done little or nothing in the actualisation and application of these universal principles in its member states. There are plethora legal frameworks geared toward promoting and protecting human rights and democratisation in Africa. However, they have translated meaningless because their practical applications are neglected.

The establishment of the AU inter alia is anchored on the promotion and protection of human rights and democratisation in Africa. This is as a result of the inhuman and undemocratic experiences of the continent under the so-called colonial masters’ bad governance. In an attempt to correct the human rights catastrophes perpetrated by colonial institutions, the AU was created. Thus, the sole intent of the drafters of the Organisation’s legal framework and indeed the yearning and aspiration of the people of the continent was to create a continental institution to promote and protect human rights and democratisation which are essential for the development of Africa.

However, legally construing the AU Charter, it creates no legal binding obligation on state parties for promotion and protection of human rights and democratisation in Africa. Although, it requires member states to have due regard for human rights and democratisation as enshrined under international law; and also promulgated plethora continental laws aimed at mandating state parties to promote and protect these concepts.

A hijacked youth that wants to go home

Blurred lines come to mind when defining the word “youth” in Eritrea.

There are multiple global ranges afforded to the term “youth”; the United Nations (UN) declares a range of 15 to 24 years old, and the African Youth Charter settles for 15 to 35 years of age. One common definition is to observe youth as a transitional phase from dependent childhood to independent adulthood, a time when parental guidance and experience are equipping children with the tools to construct an independent adult self.

When interviewing young people who left Eritrea, it troubles me that I cannot capture that moment, that space reserved for such transition. I asked 18 year old Hermon* when she first recalled hearing about the compulsory national service introduced in 1995, which systematically recruits people from the ages of 18 to serve their country. Her response was:

I knew what national service was when I was eight years old because there was a round-up [known as giffa] and they took my mother during the night.

By the time Hermon was 12 years old, her mother came to her at night and asked if she would be prepared to “take a long and difficult trip”. She agreed, not knowing that what lay ahead was three days and nights of travel to arrive in Khartoum, Sudan and live for four-years as a member of a nameless, faceless and poor refugee mob. Hermon did not comprehend the risk she and her mother took: the risk of being detained for desertion or the risk of becoming victims of the ‘shoot to kill’ policy at the borders. At 12 years, she could not have possibly understood but saw the fear in her mother’s eyes, who arranged this journey for her daughter so she would never have to go to Sawa or any other military training camp.

Drawing lessons from the protection of taxpayers’ rights in Europe

“You can have a Lord, you can have a King, but the man to fear is the tax collector”- Sumerian proverb.

Today, fearing the tax man does not seem to hold true when it comes to the protection of taxpayers’ rights in most European countries. Indeed, for several decades now, taxpayers’ rights in Europe have been benefiting from internationalisation of human rights process. Under the impulse of case law from the European Court on Human Rights (ECHR) and the European Court of Justice (ECJ), human rights have become a fundamental part of taxation. While Africa is running the marathon of attracting and boosting private investments, it may be vital to stimulate the interaction of these two areas of law as a means to strengthen the rule of law on the continent.

In Africa, tax is primarily regarded as a civic duty. Article 29 (6) of the African Charter of Human and Peoples’ Rights (hereinafter referred to as “the Charter”) states that “the individual shall also have the duty (…) to pay taxes imposed by law in the interest of the society”. It follows in particular that the state has the right to levy taxes on its citizens, whether individual or corporate. In contrast, citizens are entitled to enjoy property rights in respect of Article 14 of the Charter or any other pertinent instrument relating to international human rights law. Since the state and its citizens have opposing interests, a balance is obviously required between the individual’s right to property and the state’s right of establishing taxes. In others words, in case of a dispute regarding taxation, the judge should be able to censure any excessively high tax burden on citizens.

The African Union summit on the International Criminal Court: In whose interest?

On 13 October 2013, leaders of African states will meet in Addis Ababa, under the African Union (AU) banner), to consider a possible withdrawal from the Rome Statute creating the International Criminal Court (ICC). African leaders do not find favour with the ICC’s pursuit of Kenya’s “big men”- President Uhuru Kenyatta and Deputy President William Ruto. The AU draws links between the indictment of Kenyatta and Ruto with that of President Omar Al-Bashir of Sudan and Laurent Gbagbo of the Ivory Coast. Having drawn such links, the AU is of the view that the ICC is a western plot to finish-off African leaders. What is striking of the AU’s ICC analysis is the complete lack of consideration for the victims, 99.9% of whom are Africans. It seems as though grave crimes against humanity are of much less importance when a few “big men” stand accused.  What seems to be of extreme importance in the minds of African leaders is that, once again, one of their kind is wanted for crimes against humanity.

African heads of states are rarely united on any issue relevant to development of the continent, such as a common currency, the free movement of people and products, military interventions in war torn regions, etc. However, when it comes to protecting the likes of Bashir and Kenyatta, the AU is zealously united – without regard to the victims of atrocities.

Unmanned Aerial Vehicles: Call for an African Union resolution on the use of drones in Africa

On 15 March 2013 Chief Judge Merrick Garland of the United States (US) Court of Appeals Circuit in American Civil Liberties Union Foundation v Central Intelligence Agency (CIA) dismissed the CIA’s standard Glomar response to its expanded and clandestine programme to carry out targeted killings on suspected terrorist. Barely two months later, a High Court in Peshawar, Pakistan, held that drone strikes (and their continued use) “are a blatant violation of Basic Human Rights and are against the [United Nations] (UN) Charter, the UN General Assembly Resolution …and a violation of the sovereignty [of Pakistan]”. Whereas not fully specific on the human rights instruments violated, these judicial pronouncements point to an increasing dissatisfaction by the international community on the lack of a concise and regulated use of the “CIA’s angry birds”.

This note seeks to merely highlight possible violations of various rights including the right to life, right to fair trial as well as the right to privacy, which are all enshrined in the African Charter; and call upon the African Union (AU), through its various organs, to promote more transparency on the use of drones and foster the enactment of a continental regulatory framework to govern the use of Unmanned Aerial Vehicles by western nations on African soil.

The use of drones in African’s airspace has been on a steep rise. The latest documented incident was on 27 May 2013 when Al-Shabaab allegedly shot down a UAS Camcopter S-100 near the town of Buulo Mareer, southern Somalia. The London based Bureau of Investigative Journalism estimates that over 200 persons, mostly non-combatants, have been killed by drone strikes in Somalia since 2003. American drone support bases have been reportedly set up in Arba Minch (Ethiopia), Seychelles, Camp Lemonnier (Djibouti) and recently in Somali’s shell-crated international airport in Mogadishu. A 2012 study by Stanford Law School and New York University’s School of Law indicated that there were more civilians and innocent residents killed in the drone strikes than militants throughout the period of the drone program.

Realising inclusive education for children with disabilities in Lesotho

Inclusive education advocates for educational systems with an approach that serves the needs of all learners while identifying and overcoming barriers that prevent persons with disabilities from being included in the educational system. Lesotho has a high literacy rate of 87%. In spite of this commendable figure, about 40% of children with disabilities (CWDs) between the ages of 5 and 10 do not attend primary school while 23% of children with disabilities between ages 10 and 20 do not attend high school. These figures are significantly higher when compared to children without disabilities in the same age groups.

The Constitution of Lesotho recognises education as a directive principle of state policy under Chapter 3 of the Constitution and not as a justiciable right. However, the Child Protection and Welfare Act of 2011 and the Education Act of 2010 expressly affirm the right of children with disabilities to education. In addition, Section 4(2)(b) of the Education Act imposes an obligation on duty bearers to ensure that children with disabilities are included in the educational system. The right to education is also protected under Article 24 of the United Nations Convention on the Rights of Persons with Disabilities (CRPD). This provision also places an obligation on state parties not to exclude children with disabilities from free and compulsory primary education, and that the inclusion is complemented by accessibility, reasonable accommodation, and effective individualised support aimed at maximising academic and social development. Lesotho ratified the CRPD in 2008 and adopted a free universal primary education in 2001 as a means of achieving education for all. Lesotho has a National Disability Policy of 2011, the Education Sector Strategic Plan 2005-2015, and the Special Education Unit all geared towards achieving inclusive education for people with disabilities. The legal implication of these laws and policies is that the government of Lesotho has obligations under international and domestic law to ensure that children with disabilities are not excluded from the general educational system and that children with disabilities can learn on an equal basis with abled children. However, children with disabilities still do not attend primary school. There is a huge gap between the legal framework and the practical implementation of inclusive education in Lesotho.

Corruption in Ethiopia: Causes and remedies

It is often heard (from all concerned) that corruption levels in Africa and particularly in Ethiopia are of concern. Corruption is not only a violation of law and order, but a massive cause for the exacerbation of poverty already entrenched in the society. It frustrates any genuine effort exerted towards societal and economic development both by the government and the people. The ill sides of corruption are not to be undermined nor should efforts to fight it be played up as a political game just to prolong the life of a specific regime posing as the “good guy”. The fight against corruption must not be a tactical step for public attention and a ploy to win the sympathy of people. The fight against corruption by all Ethiopian stakeholders should investigate the root causes of corruption to address the problem sustainably for the following reasons: Ethiopia is cultivating tens and thousands of graduates from universities and technical colleges every year and the lack of jobs is becoming a serious concern.

According to a report by Global Financial Integrity, Ethiopia lost close to $12 billion since 2000 to illicit financial outflows. This is simply disaster in the making. The government must be serious in its fight against corruption because the government’s credibility and whatever level of legitimacy it might have been commanding is put to question. Therefore, in the government cadres’ language, “fighting corruption ought to be a survival issue”.

Every time I hear of anti-corruption efforts in my country, my pain is immense and is summed up by a phrase in the Amharic language “sedo masaded”, roughly translated as “trying to arrest after cutting lose”; the question is why “cut lose”? Why not fix the fence? Why not shut the door to thieves and the corrupt? The question for all of us is how to secure the house. The solution lies in “institutionalising the rule of law”; subsequently, if anyone subverts the system, all due processes of the law must ensue and no one should be considered or consider themselves above the law.

Freedom of the press? Not for the Ugandan press

The freedom to form opinions and express them without fear of repression is a fundamental tenet for the development of a pluralistic, tolerant, and democratic society. This right represents not only the right to privacy of individuals to hold opinions and formulate thoughts, but also to express them in a public forum, especially as part of exercising the right to political participation. In addition, the right to access information, that is the right to seek and receive information, which also forms an important component of this right and which has added significance in the current age of information technology, is intrinsic to the transparent functioning of a democratic government and the effective and well-informed participation of civil society. In this context, freedom of opinion, expression and information is one of the core civil and political rights as it is essential for the exercise of all other human rights.

The right to freedom of opinion, expression and information is well-established and protected at both international and regional levels both legally and institutionally. The right is enshrined in various international instruments, namely: the Universal Declaration of Human Rights (Article 19), the International Covenant on Civil and Political Rights (Article 19), the International Convention on the Elimination of all forms of Racial Discrimination (Article 5(d)(viii)), the Convention on the Rights of the Child (Article 13) and the Declaration on Human Rights Defenders (Article 6). The main international human rights body within the United Nations system, the Human Rights Council, also provides through its system of special procedures for a Special Rapporteur on freedom of opinion and expression, which was established in 1993.

Xenophobia in South Africa: The time for introspection has come

Xenophobia, just like so many other unsettling issues in South Africa, is gradually becoming part of the way in which we are perceived as a society. The newest upsurge in xenophobic violence clearly indicates that we have not made significant progress since the problem surfaced in 2008. More unsettling however, is the unwillingness of South Africans from all levels of society to acknowledge and address the problem – media houses neglect to conduct in-depth investigations, politicians fail to express their concern over the issue, the South African Police Service controversially fuels public perception through its involvement in incidents regarding foreign nationals, and civilians exercise mob executions with self-righteousness and pride.

The South African Constitution offers protection to citizens and non-citizens, and is one of few constitutions in the world that indisputably does so. The preamble of the Constitution reiterates South Africa’s commitment to uphold the rule of law, and this commitment greatly depends on consistent application of the law in South Africa. It is imperative that South Africans understand that our own claims on the protection of and rights entrenched in the Constitution depend on respecting the rights of others. Arbitrary mob killings of foreign nationals during the past five years suggest that South Africans struggle to come to terms that all people are equal before the law. Allegations of foreign nationals being involved in criminal activities often lead to mob justice, which is a dangerous step towards corroding the rule of law, and eventually the Constitution upon which our society so greatly depends.
