After two years of negotiations the Principles of Responsible Investment in Agriculture and Food Systems (PRIAF) were approved by the Committee on World Food Security (CFS) on October 15, 2014. This has been endorsed by some as a breakthrough for realising the right to adequate food and ensuring food security for all.
Since the 2007/2008 global economic crisis, agricultural investments, particularly large scale investments have flourished across the globe. Africa has become a major destination for large scale agriculture investors largely due to the cheap and fertile land, and poor protection of land rights. The investments are apparatuses of the market led agricultural trade liberalization model claimed to be the panacea for food insecurity in the world by hegemonic industrialized states.
It is evident that some of these investments have utterly affected the right to adequate food in Africa and elsewhere as the investments, for instance, displaced people from their land, or registered futile contribution to food security and nutrition. For this reason some practitioners proposed human rights based regulation of global and national food and nutrition related policies. Nevertheless the investors and host nations defended the investments and denied the adverse effects.
The PRIAF was born out of these competing views on agricultural investments. It brought together major stakeholders to come into consensus on common principles on how to conduct agriculture investments. It is an effort to regulate agriculture investments globally; and to strike a balance between investment promotion and protection of human rights and ensuring sustainable development.
Freedom of expression for a day in Eritrea

International Day to End Impunity for Crimes against Journalists: 2 November 2014
In a land where the right to freedom of expression and information is heavily curtailed, I sought to interview three exiled Eritrean journalists and allow them the space to freely express what they cannot in their country.
Why did you choose to become a journalist?
*Aman: “I used to be a development worker; I was taken to prison camps and three times I saw people tortured and killed. I started to write stories and post articles on what was happening…I became a journalist by accident – all I wanted to do was contribute to justice”.
Since Eritrea’s “liberation” from Ethiopia in 1991 and its international recognition as an independent sovereign state in 1993, the country gradually evolved into a nation rife with human rights abuses. Notably, the systematic attack on dissent of any form resulting in extrajudicial killings, torture, arbitrary arrests and indefinite incommunicado detentions.
What does freedom of expression mean to you?
Aman:” It is a symbol of democracy- the flow of information without fear or restrictions – the means to freely enlighten and educate”.
18 September 2001 was coined as the Eritrean government’s ‘Crackdown’ on all independent media, when it banned the entire private press by shutting down media houses. It also marked the end of dissenting voices at the political level. Eighteen journalists, as well as eleven political leaders were rounded – up and imprisoned incommunicado without trial. Their whereabouts are still unknown till today. Since then, more than 70 journalists have been detained at different periods in time.

When the World Health Organisation (WHO) declared “a public health emergency of international concern” in the three fragile West African states of Guinea, Liberia and Sierra Leone, the walls fast closed on them and their peoples. Flight bans, citizen entry bans and ripple effects on trade have been announced by African countries, as well as globally. So severe have been the restrictions that vital energy and food supplies have dwindled, with riots breaking out in some areas. The affected countries have pleaded with “the world” to not inflict collective punishment on their populations, and indeed future.
These real world events have grounding in probably the most innocuously titled yet powerful treaty in the world. Nope, not the UN Charter, not the Geneva or Vienna Conventions… the International Health Regulations (IHR 2005). Usually, ‘regulations’ is legalese for subsidiary legislation. But these regulations treat probably the most incendiary issues in human society: infectious diseases and legality, if not morality of mitigating actions.
The IHR’s aim to provide maximum protection from the international spread of infectious diseases while causing minimal harm to global travel and commerce. It originates from the 1892 International Sanitary Convention that sought to control the spread of cholera in the Suez Canal, providing for coercive ship inspections and quarantines.
It may well be said that the Achilles-like duality of IHR, its true power and weakness, lies not in legal theory but sheer human behaviour. Infectious diseases are frightening. They compound the unknown and bring out the worst elements of our self-preservation instinct. Prior to the 2005 revision, states like India and Peru sat on critical information about disease outbreaks to avoid the punishing reactions of other states. Given the treatment of Guinea, Sierra Leone, Liberia, one wonders what exactly has changed in the real world.
Freedom of expression under attack in Swaziland

The recent arrest and imprisonment of The Nation magazine editor, Bheki Makhubu and Thulani Maseko, a human rights lawyer and the magazine’s columnist for contempt of court, while shocking the world, has exposed the government’s malevolent desire to suppress freedom of expression and crash dissent.
The two, who were arrested after publishing articles questioning the detention without trial of a government vehicle inspector, have subsequently been sentenced to an effective two years in prison.
Swaziland’s Constitution of 2005 clearly provides for freedom of expression in section 24. It stipulates that every person has a right of freedom of expression and opinion. Harassment, torture, incarceration of journalists or any other attempts to suppress free speech is a violation of this constitutionally guaranteed right.
The incarceration of the two is not an isolated incident but rather a highlight of the repressive regime’s longstanding intention to suppress freedom of expression. To understand Swaziland’s lack of freedom of expression it is important to look into the country’s media landscape. The government has maintained a tight grip on the media so as to control the information being disseminated while the few ‘independent’ media outlets have been constantly attacked leading to unprecedented levels of self-censorship.

The globalisation of human rights and democratisation has gained significant momentum in the 21st Century. It has proved to be the linchpin of progressive and sustainable socio-economic and political development for other continental organisations such as European Union and Inter-American Organisation. It is unfortunate that the African Union (AU) has done little or nothing in the actualisation and application of these universal principles in its member states. There are plethora legal frameworks geared toward promoting and protecting human rights and democratisation in Africa. However, they have translated meaningless because their practical applications are neglected.
The establishment of the AU inter alia is anchored on the promotion and protection of human rights and democratisation in Africa. This is as a result of the inhuman and undemocratic experiences of the continent under the so-called colonial masters’ bad governance. In an attempt to correct the human rights catastrophes perpetrated by colonial institutions, the AU was created. Thus, the sole intent of the drafters of the Organisation’s legal framework and indeed the yearning and aspiration of the people of the continent was to create a continental institution to promote and protect human rights and democratisation which are essential for the development of Africa.
However, legally construing the AU Charter, it creates no legal binding obligation on state parties for promotion and protection of human rights and democratisation in Africa. Although, it requires member states to have due regard for human rights and democratisation as enshrined under international law; and also promulgated plethora continental laws aimed at mandating state parties to promote and protect these concepts.

It is now eighteen years since the National Policy on the Care for Persons with Disabilities was adopted in Botswana and to date people with disabilities have only this policy that speaks to their issues. Children with disabilities, who are among the most vulnerable groups of children in Botswana, are still being handled in a ‘medicalised’ manner. These children are segregated especially in the educational system which lacks any form of inclusive education. They have an opportunity to gain formal education only in special schools, most of which are owned by non-governmental organisations such as Cheshire Foundation and Camphill Community Trust. This is completely contrary to the right to inclusive education as guaranteed in international human rights instruments particularly the Convention on the Rights of Persons with Disabilities (CRPD). Inclusive education is a method of education that gives equal opportunity to children with disabilities by guaranteeing their rights to education and creating an amiable environment to realise that right on an equally basis with other children.
Botswana currently has a Draft Reviewed National Policy on the Rights of Persons with Disabilities which has remained a draft since it was drafted in 2010. There is also the Inclusive Education Policy of 2011 which has not had any positive impact on the lives of these children as they are still completely ‘out of the picture’ of mainstream schools, and very little provisional mechanisms have been instituted to address their needs. Camphill Community Trust, for example, is located out of the city of Gaborone, which is an indication of how children with disabilities are treated in Botswana: Not fit for mainstream schools. The policy currently in force is the 1996 National Policy on Care for People with Disabilities. This is a policy with a purely medical approach that focuses on the ‘disability’ as in need of cure and rehabilitation instead of providing the necessary conditions in the society to enable children with disabilities to realise their full potentials. The word “care” implies people who should be taken care of; a social encumbrance which should be remedied through social welfare initiatives and goodwill. This situation is made worse by the fact that Botswana does not have a National Human Rights Institution which could have championed the course of the rights of these children.
Crusade to root out homosexuality like malaria

The Gambia is largely Muslim-dominated, with about 95 per cent of the population being Muslims. It is also highly traditional. Thus, Islam significantly influences people’s ways of lives. In the recent years, there has been much discussion, in the media and political fora, about homosexuality and homosexual rights in The Gambia. The attitude of the ordinary Gambian towards homosexuals is outright hostile, fanned by the extreme condemnation from both political and religious leaders. People are made to believe that homosexuals are cursed and support for homosexual rights would spell doom for Islam and Gambian culture, whatever that means. Due to this charged hostility towards homosexuals, there are only few lone voices that dare to challenge current beliefs about and hostility towards homosexuality or campaign to hold the state accountable for the respect, protection and fulfillment of the sexuality rights. The criminalisation of homosexuality provides the state with an opportunity to violate the rights of homosexual with impunity and absolute disregard for the rule of law.
The arch opponent of homosexuals and their rights is the president of The Gambia. During the recent celebration s to mark The Gambia’s independence celebration, on 18 February 2014, President Yahya Jammeh stated that his government “will fight these vermin called homosexuals or gays the same way we are fighting malaria-causing mosquitoes; if not more aggressively”. He further noted that The Gambia would not spare any homosexual, and that no diplomatic immunity would be respected for any diplomat found guilty or accused of being a homosexual. The next day, United States’ Secretary of State John Kerry denounced the President Jammeh’s comments, calling on the international community to send a clear signal that statements of this nature are unacceptable and have no place in the public dialogue.
Chapter 9 institutions: for the sake of accountability and constitutional democracy

It is in the wake of the Public Protector’s findings regarding an upgrade to the President Zuma’s private residence in Nkandla that, the importance and our tolerance for Chapter 9 institutions comes to the fore. Having presented her findings to the public, the Public Protector was hailed by some as a heroin to a South Africa that is ridden with corruption, whilst some questioned her credibility and the integrity of her office. It is submitted that these debates are ordinary in a vibrate democracy like South Africa’s and should be welcome. However, what should not be welcome are unsubstantiated remarks aimed at undermining the office of the Public Protector, or any of the other Chapter 9 institutions, namely, the South African Human Rights Commission; the Commission for the Promotion and Protection of the Rights of Cultural, Religious and Linguistic Communities; Commission for Gender Equality; the Auditor General; and Electoral Commission. These institutions, as provided for in section 181 of the Constitution, form a cornerstone to the sustenance of democracy and are important for the full realisation of other democratic principles such as accountability, respect for the rule of law and human rights.
